Department of Health HIV Testing Service Website User Agreement

General Terms

Services for HIV Testing Service website users

  1. The HIV Testing Service website (“the Website”) is produced and maintained by the Special Preventive Programme (SPP) under the Department of Health (DH) of the Government of the Hong Kong Special Administrative Region. Some services (hereinafter referred to as “specific services”) are specially designed for users who have registered accounts on the Website, to facilitate them to order HIV self-test kits.
  2. Please read this user agreement carefully. By using the service and/ or registering an account on the Website, it means that you acknowledge and agree to be legally bound by all the terms and conditions of this user agreement (“Terms”). If you do not agree to the Terms, please do not use the services and/ or create an account on the Website.
  3. The following specific services are currently available to registered users of the Website:
    • Online ordering of HIV self-test kits and related services, including:
      • Upload results
      • Review the results
      • Use promotion code
      • View order record

    • Online booking of the AIDS Counselling and Testing Service and related services provided by the DH’s “AIDS Hotline 2780 2211”, including:
      • Change/cancel appointment
      • Review appointment records
      • Check follow-up requirement (if applicable)
      • Activate/deactivate receiving SMS reminder service

  4. SPP will review the service content and procedures of the Website from time to time, and may add, modify, suspend or terminate any services and any procedures for the use of such services without giving any prior notice to any user (including the Website account holder).
  5. We do not guarantee the services provided by the Website can be used in other regions outside Hong Kong. When you use the related services in regions outside Hong Kong, you may also be subject to the laws of the region you are visiting and we are not liable for your non-compliance.
  6. When you use the services provided by the Website, you should be aware that your mobile network service provider may charge you for using the mobile data network. When using roaming services in regions outside Hong Kong, you may have to bear additional data roaming services charges.

Register a user account on HIV Testing Service website

  1. You are required to provide the following information to register a user account on the Website:
    • Email address
    • Hong Kong mobile number (that allows you to receive SMS for verification code)
  2. The user account must be for your own use only. You must not register for and on behalf of another person.
  3. You can only register one user account on the Website. The mobile number submitted for registration must be correct and valid. A virtual mobile number is not acceptable for account registration. If it has been identified that virtual mobile number has been used for registration, we shall have the right to, without any prior notice, immediately suspend or terminate such account.
  4. During registration, you are required to give your consent for the collection and use of your personal data as described in the “Personal Information Collection Statement”.
  5. Based on the consideration of your personal privacy protection, the Website provides services in an anonymous manner. The HIV Testing Service website system will use your email address and Hong Kong mobile number as unique identifiers for identification, therefore you cannot share your email address or Hong Kong mobile number with another user.

Using your HIV Testing Service website account

  1. You must input the following information to log in to your account:
    • Your registered email address; and
    • The one-time password that obtained via your registered mobile number
  2. After logging into the account, you can change your login email, mobile number and settings of notification SMS.
  3. If you forget your login email, you can click “Forgot Email” on the account’s “Login” page and then follow the steps shown to retrieve your login email (Please note: Based on the consideration of your personal data privacy protection, the login email retrieval function will only provide part of the registered email information for you to identify, for example: cxxxxxx4@abc.com will be shown for the email chan1234@abc.com ).
  4. If you need to change the mobile number, you can click “Change phone number” on the account’s “Login” page or you can log in your account and click “Edit” under the section of “Phone Number” of the “My Profile” page. Then, follow the steps shown to update the mobile number.
  5. Some of the services allow you to upload or submit content (“user content”). You submit any user content at your own risk.
  6. You must not upload or submit any user content which is libellous, defamatory, threatening, intimidating, harassing, hateful, offensive, discriminatory, pornographic, obscene, or is in any way in breach of the laws of Hong Kong Special Administrative Region or infringes any intellectual property rights..

Suspension of your HIV Testing Service website account

  1. If you breach any of the Terms set out herein or other suspicious circumstances relating to your account, SPP may suspend your account without prior notice.
  2. If SPP suspects that any person (other than by yourself) log into your account and/or use specific services of the Website, SPP may suspend your account without prior notice.
  3. Once your account is suspended, you will not be able to log in your account and use specific services offered to registered users.
  4. If you encounter any issues while logging into your account, you can call AIDS Hotline at 2780 2211 to contact staff of SPP.
    Service hours: Monday to Friday 8:30 am – 5:15 pm (Saturday, Sunday and Public Holiday: Closed)

Termination of your HIV Testing Service website account

  1. SPP may terminate your account without giving any notice if you breach any of the Terms.
  2. You can contact staff of SPP to cancel your account without fee or penalty.
  3. If your account is terminated, or you choose to terminate the account, your account will be considered as invalid, and you are no longer log in to the account and use the specific services offered to registered users of the Website.
  4. Once the account is terminated, the relevant account data cannot be restored and retrieved.

Modifications of the Terms

  1. SPP may from time to time vary, modify, delete, and/or add any terms or conditions in the Terms at its own discretion.

Personal Information Collection Statement

Purpose of collection

  1. The personal data are provided by patients and clients with whom the DH interacts in the delivery of services, and other related activities. The personal data provided will be used by DH for the following purposes:
    1. For applying HIV Testing Service;
    2. Record of test results / examination / investigation / treatment for continuation of care or reference by other medical professionals;
    3. Consent for particular treatment / tests;
    4. Accounting of expenses;
    5. Epidemiological surveillance;
    6. For reference in legal proceedings;
    7. Proof of consent for medico-legal examinations;
    8. For preparing statistics, carrying out research or teaching purpose
    9. To handle matters regarding service quality control, comments, suggestions, enquiries, and/or complaints in relation to SPP or DH; and
    10. Facilitating organisation of activities related to HIV prevention and testing.
  2. The provision of personal data is voluntary. If you do not provide sufficient information, we may not be able to provide you with certain services/assistance.

Classes of Transferees

  1. The personal data you provided is mainly for use within DH and third-party service providers authorized by DH when providing services to you (including providing HIV testing service as described on the Website, such as logistic services of HIV test-kits, or providing you with related support and inquiry services, etc.), but it may also be disclosed to other Government bureaux / departments, the Hospital Authority or relevant parties for the purpose listed above in para 27, if required. Apart from this, the data may only be disclosed to parties where you have given consent to such disclosure or where such disclosure is permitted under the Personal Data (Privacy) Ordinance.
  2. All of the authorized third party service providers are bound by contractual duty to keep confidential any data they come into contact with against unauthorized access, use, retention, disclosure and transfer.

Access to Personal Data

  1. You have a right of access and correction with respect to your personal data as provided for in Sections 18 and 22 and Principle 6 of Schedule 1 of the Personal Data (Privacy) Ordinance. Your right of access includes the right to obtain a copy of your personal data provided by you during the occasions as mentioned in paragraph 27 above. A fee may be imposed for complying with a data access request.

Information Security

  1. You are responsible for taking all reasonable precautions to protect the data in the account of the Website safe, and prevent any unauthorized use. The precautions may include but are not limited to the following:
    • never write down or otherwise record your security information in a way that can be understood by someone else
    • take care to ensure that no one hears or sees your security information when you use it
    • once you have logged in your account, do not leave your device unattended and not let anyone else use your device
    • log out your account once you have finished using the services
  2. If you know, or suspect that others knows your security information or using your account without authorization or violate security regulations, please change your security information immediately and notifying us as soon as possible through email (hivtest@dh.gov.hk).
